  1. VALIDITY OF TERMS OF SALE

1) These Terms of Sale apply to all purchases of goods and services made by the buyer (hereinafter the Customer) from the online store www.foreststeel.ee operated by Forest Steel OÜ (hereinafter the Online Store).

2) In addition to these terms, the legal relations arising from purchases made in the online store www.foreststeel.ee are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CPA) and other legislation in force in the Republic of Estonia.

3) The Online Store www.foreststeel.ee reserves the right to amend these Terms of Sale. Any amendments will be published on the website www.foreststeel.ee

  1. PRICE INFORMATION

1) All prices displayed in the Online Store are in Euros and include 24% value added tax (VAT).

2) The delivery fee corresponding to the shipping method selected by the Customer during the checkout process will be added to the product price. The shipping method is selected and the delivery fee is calculated in the shopping cart.

3) The terms and prices valid at the time of the transaction shall apply to the transaction.

4) The Online Store www.foreststeel.ee reserves the right to amend prices and terms of sale. Any amendments will be published on the website www.foreststeel.ee

  1. PLACING AN ORDER

1) Add the desired products to the shopping cart.

2) On the checkout page, fill in the required fields and select your preferred delivery method. You can pay for your order conveniently via bank link as a euro payment. Review your details once more and click the “Submit order” button. An invoice including all applicable national taxes and additional fees will then be displayed on the screen.

3) Please fill in the fields on the data and order confirmation page carefully, as the accuracy and correctness of the information provided will determine the fast and smooth delivery of your purchased products and the resolution of any future disputes and complaints.

4) Pay for your order using a bank link or credit/debit card (Visa/Mastercard). Secure bank link and credit/debit card payment solutions are provided by Montonio: Swedbank, SEB, LHV, Luminor, Coop Pank, Citadele, Šiaulių Bankas, Medicinos Bankas, Nordea and OP.

5) The Online Store reserves the right to withdraw from the contract or withhold delivery of the ordered product if the product is out of stock or has been displayed incorrectly due to a system error. If the product ordered by the Customer is unavailable, the Online Store shall cancel the order. The order may be cancelled partially or in full. The Customer will be notified of the cancellation immediately. In the case of partial cancellation, the Online Store may ask the Customer how they wish to proceed with the remaining order – whether to ship it or cancel it as well.

  1. ENTRY INTO FORCE OF THE SALES CONTRACT

1) Under the sales contract, the Online Store undertakes to deliver the goods to the Customer and to enable the transfer of ownership to the Customer, and the Customer undertakes to pay the amount indicated on the invoice and to accept the goods.

2) The sales contract is deemed concluded upon the receipt of 100% of the amount indicated on the order into the Online Store’s bank account.

  1. DELIVERY

1) After the sales contract enters into force, the Online Store shall process the order within five business days at the latest and hand it over to the logistics partner selected by the Customer for delivery. From the moment of handover, it takes 1–3 business days for the order to reach the parcel locker selected by the Customer. Foreststeel.ee is not responsible for delays caused by the postal service provider in delivering the goods to the buyer.

2) The logistics partner will notify the Customer of the arrival of the order if a parcel locker has been selected as the delivery method.

3) The delivery deadlines indicated on the Online Store website are effective from the moment the order amount is received in the Online Store’s bank account.

4) To ensure timely delivery, please provide accurate and valid delivery information when placing your order.

5) The Online Store is not responsible for delays in the delivery of goods.

  1. RIGHT OF WITHDRAWAL

1) After receiving the order, the Customer has the right to withdraw from the contract concluded in the Online Store without giving a reason within 14 days.

2) If the condition of the item to be returned has deteriorated, the Customer is liable for any decrease in value resulting from the use of the item, provided that the item has been used in a manner other than what is necessary to establish the nature, characteristics and functioning of the item. The product must be in the same condition as when it was delivered to the Customer.

3) To return the goods, the Customer must send a corresponding notice to the e-mail address within 14 days of receiving the goods.

4) The Customer must return the goods within 14 days of submitting the notice or provide proof that the goods have been handed over to a logistics company within the aforementioned period using a tracked service. The Online Store has the right to delay the refund until the Customer has returned the product and the Online Store has received it and verified that it is in proper condition.

5) Upon receipt of the withdrawal notice, the Online Store shall refund all payments received from the Customer under the contract within 14 days, including the delivery costs of the item, except where the Customer has expressly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, in which case the Online Store is not obliged to refund the cost exceeding the cost of the standard delivery method.

6) If the returned product has deteriorated due to circumstances not attributable to the Online Store but rather to improper use of the product or other circumstances, the Online Store has the right to offset the decrease in the product’s value against the amount to be refunded to the Customer.

7) The costs associated with the return shall be borne by the Customer.

  1. FORCE MAJEURE

1) The Online Store shall not be liable for any damages caused to the Customer or for delays in the delivery of goods if the damage or delay is due to circumstances beyond the control or foresight of the Online Store.

  1. PROCESSING OF PERSONAL DATA

1) By entering data in the Online Store and providing the corresponding confirmation, the Customer grants the right to collect and process the Customer’s personal data (name, contact phone number, delivery and/or home address, e-mail address) in the following ways:

2) The Customer has the right to request details of the data collected about them and to ask the Online Store to correct any inaccuracies, to object to the processing of data or to request its restriction, and to request access to, deletion of, or transfer of the data. 3) The Customer has the right at any time to prohibit the collection and use of their personal data, except where this is necessary for the enforcement of a claim arising from the contract or for the delivery of goods. Certain personal data may be retained in the Online Store’s records and archives for some time in accordance with applicable laws, but the Online Store will not use such data for commercial purposes.

4) We do not retain your personal data longer than necessary for the purpose for which it was collected. This means that data is destroyed or deleted from our systems when it is no longer needed. Forest Steel OÜ is the data controller and the company forwards the personal data necessary for processing payments to the authorised processor Montonio Finance OÜ.

5) Encrypted communication with banks when paying for purchases ensures the security of the Customer’s personal banking credentials, and the Online Store does not have access to them.

  1. COMPLAINTS PROCEDURE

1) In the event of a defect, the Customer has the right to contact the Online Store within two months at the latest, presenting the invoice on the basis of which the purchase was paid for.

2) If a defect is discovered in the product, please discontinue use of the product.

3) The repair or replacement of a defective product shall be agreed upon between the Online Store and the Customer.

4) The Online Store is not responsible for defects in the product caused by the Customer’s fault, resulting from improper storage or use of the product for unintended purposes.

5) In the event of non-conformity or defects in the product, please send a complaint to the e-mail address , including the name of the person who placed the order, contact phone number, order number and a precise description of the non-conformity or defect.

6) A complaint regarding the discovery of non-conformity or defects in the product must be submitted within two months of discovering the non-conformity or defect.

7) All complaints will be reviewed and the Customer will be contacted at the earliest opportunity, but no later than within 14 days of receipt of the complaint.

8) The Customer has the right to demand a reduction in the purchase price or termination of the contract and a refund for the goods if the Online Store is unable to repair or replace the goods, if the repair or replacement fails, if the Online Store has not remedied the defect within a reasonable time, or if the Customer has been caused unreasonable inconvenience.

  1. CUSTOMER’S RIGHT TO CONTACT THE CONSUMER DISPUTES COMMITTEE

1) If the Online Store has refused to resolve the Customer’s complaint or the Customer does not agree with the solution offered by the Online Store and believes that their rights have been violated or their interests have been harmed, the Customer may file a complaint with the Consumer Disputes Committee through the Consumer Protection and Technical Regulatory Authority or with the court. The consumer may file the complaint personally or through a representative. The details of the Consumer Disputes Committee can be found on the website of the Consumer Protection and Technical Regulatory Authority. For resolving problems arising in European Union Member States, please contact the European Consumer Centre.

TRANSPORT AND DELIVERY TIMES

DELIVERY OF GOODS

When placing an order within Estonia, you can pick up the goods in person, from a SmartPOST parcel locker of your choice, or have them delivered via the ACE Logistics business-to-business aceFlex courier service.

For international orders, goods are delivered at a competitive price via the aceFlex courier service. We deliver to all European Union countries and worldwide.

You will receive your goods quickly – we process your order as fast as possible, usually on the same day, but no later than within five business days of placing the order.

ORDERING TO A PARCEL LOCKER

The order will arrive at the parcel locker selected by the Customer within five business days of receiving the order confirmation. The Customer will be notified of the arrival of the goods at the parcel locker by an SMS sent by the logistics company, which contains the security code needed to open the parcel locker.

ORDERING VIA COURIER SERVICE

The courier service delivery time is indicated in the online store. Delivery time depends on the selected product and the distance between the origin and destination. For Estonia and neighbouring countries, the delivery time may be 1–3 business days and for longer distances up to 10 business days.

Various delays may occur during transport due to adverse weather conditions, customs or backlogs. If your shipment has not arrived within ten days after the expected delivery date, please contact us so that we can begin searching for lost items in cooperation with our logistics partner.
